Using it for professional legal work is like using a personal Gmail account for attorney-client communications: technically possible, structurally dangerous.
Failure Mode 2: Single-point-of-failure infrastructure. Chase's phone number was a Google Voice number. His email was Gmail. When Google killed his account, it didn't just remove an AI tool. Use professional or enterprise-tier AI tools for sensitive work. The reason enterprise tiers exist isn't features. It's liability transfer and a meaningfully different relationship around enforcement.
Second, read the terms of service for every AI tool you use before uploading client data. Not the summary. The actual terms. Pay attention to what happens to your account if the system flags a violation. Pay attention to the appeals process. If there isn't a clear path to a human reviewer, that's a significant risk for professional use.
Third, never build your practice on a single vendor's ecosystem. If one account shutdown would prevent you from calling your clients, that is a structural failure. Distribute your infrastructure. Your email, your phone, your document storage, your AI tools: spread across vendors, with redundancy for critical functions.
Fourth, if you work in criminal defense, child welfare, forensics, or any other area where you legitimately handle sensitive material, get enterprise agreements that explicitly cover your use case. Verbal assurances don't matter. The terms of service govern.
The Privilege Question Nobody Is Asking
There's a secondary issue buried in this story that most people will miss.
When Chase uploaded those law enforcement reports to NotebookLM, where did that data go? What did Google's systems do with it? Was it used for model training? Did it trigger manual review by a Google employee? If a Google employee reviewed the content as part of the enforcement process, is there any privilege concern?
The answers depend on Google's current data processing agreements, which most attorneys haven't read, and on whether any of the material was subject to attorney-client privilege or work product protection, which requires analysis specific to each jurisdiction.
A federal judge ruled earlier this month that SDNY courts will not treat AI-assisted documents as privileged when generated with consumer AI tools, because consumer tools involve third-party disclosure. That ruling has broader implications: every time you upload client-related information to a consumer AI platform, you are potentially exposing that information to a third party, with consequences for privilege that your clients never consented to.
